Abstract

Representation is an important legal right of parties participating in the transaction. In daily life people often ask others to do something on behalf and for the benefit of that asking person, the procedure is called representation. Although representatives can occur in different areas of life, the author of the article describes a representation in commercial contracts under the provisions of the Commercial Law and the Civil Code. The author applies a comparative approach of research and refers to the principles of international commercial contracts of UNIDROIT (international Institute for Unification of Private Law) to clarify the limited implementation of the national provisions. In the article there are author’s recommendations how to improve this regulation.
