SOME DISCUSSIONS ON THE CONCEPT OF ADMINISTRATIVE JURISDICTION IN VIETNAM

Abstract

Administrative adjudication is an activity of significant importance, especially in the context of building a rule-of-law state and ongoing judicial reform. In order to better understand the concept of administrative adjudication, this article focuses on analyzing and clarifying the notion of administrative adjudication in both its broad and narrow senses. It also examines the fundamental characteristics of administrative adjudication in Vietnam, thereby highlighting its important role in controlling the activities of state administrative management bodies. In addition, the author analyzes several current legal–theoretical issues related to administrative adjudication, such as the scope of jurisdiction, the limits of control, and the enforceability of court judgments. The article also proposes orientations for improvement in order to contribute to ensuring transparency and efficiency in the operation of state administrative management agencies, while safeguarding the lawful rights and interests of individuals and organizations.
