Abstract

In 2019, Vietnam ratified the International Labour Organization's Convention on Vocational Rehabilitation and Employment (Disabled Persons). The Convention sets out the requirements for vocational adaptation and employment for disabled persons, regulates the adjustment and evaluation of vocational guidance, training, placement and unemployment services for disabled persons. However, Vietnamese law still has many points that are not consistent with the spirit of the Convention, such as no specific definition of disabled workers, no separate regulations on equality of opportunities and treatment between male workers with disabilities for female workers with disabilities, general regulations on conditions for vocational training establishments without a monitoring mechanism,… The article will analyze and clarify the points that are not compatible between the national legal system and Convention No. 159, and on that basis propose some solutions to improve the law.
